The litigation would eliminate mail in ballots in California from being counted if they arrive at the Elections Department after election day. Currently mail in ballots must be postmarked by election day and received within 7 days of Election Day. The lawsuit alleges that ballets arriving after election day change electoral outcomes in California. There have been several motions to intervene. The latest was the League of Women Voters of California. Their motion was filed Friday. The motion contends hundreds of thousands of California voters could have their ballots wrongfully discounted. Similar motions have been filed by the ACLU Foundations of Northern California, Southern California, and San Diego and Imperial Counties. The Issa lawsuit also alleges ballots arriving after election day violates Federal election laws.
