(San Diego Border Patrol Agent granted immunity)...The agent, Dustin Sato-Smith was involved in a fatal injury collision last year.
The fatal crash involved a motorcycle. The rider, Ellis James Woodall of Jacumba suffered fatal injuries. The agent was originally charged with a misdemeanor count of vehicular manslaughter without gross negligence. Sato-Smith was able to get the charges moved out of the state jurisdiction and moved to a federal court. In Federal Court the agent argued he was immune from state prosecution because he was acting within the scope of his authority when the incident occurred. The Federal Judge agreed with that argument and granted the agent immunity.
